1. About These Terms

These Terms of Service ("Terms") govern your access to and use of suitheritage.com (the "Site") and any purchase you make from it. Suit Heritage is a trading name of Trendy Jackets LLC, a limited liability company registered in Texas, with its principal place of business at 536 Anderson Ave, Pittsburgh, PA 15239, USA ("Suit Heritage," "we," "us," "our"). By browsing the Site or placing an order, you are contracting with Trendy Jackets LLC.

By browsing the Site or placing an order, you agree to these Terms. If you do not agree to them, please do not use the Site.

Our Shipping Policy, Returns & Refunds Policy, Cancellation Policy and Privacy Policy are incorporated into and form part of these Terms.

2. Eligibility

You must be at least 18 years old, and legally able to enter into a binding contract, to place an order. By ordering you confirm that you meet these requirements and that all information you provide is accurate and complete.

We currently sell and ship within the United States only.

3. Your Account

You may place an order as a guest or create an account. If you create one, you are responsible for keeping your login details confidential and for all activity that takes place under it. Tell us promptly at support@suitheritage.com if you believe your account has been accessed without your permission.

We may suspend or close an account that we reasonably believe has been used fraudulently or in breach of these Terms.

4. Products and Descriptions

We work hard to describe our garments accurately, including fabric, construction, fit and dimensions.

• Color. Screens render color differently, and we photograph in professional studio lighting. A minor variation between our images and the garment you receive is normal and is not treated as a fault.
• Fabric and finish. Natural fabrics such as wool, cotton and linen vary slightly between production runs in weave, texture and shade. Linen in particular is expected to crease; this is a characteristic of the cloth, not a defect.
• Availability. All garments are made to order. We may withdraw or amend any product at any time. If we cannot fulfil your order, we will cancel it and refund you in full.

5. Made-to-Measure and Bespoke Orders

If you order a tailored, made-to-measure or bespoke garment, the following applies in addition to everything else in these Terms:

• Measurements are your responsibility. We cut to the measurements you submit, exactly as submitted. Please check them carefully — we recommend having someone else measure you, and following the guidance on our size guide.
• Submit your measurements promptly. You will be asked to review and confirm your measurements and specifications. Production timeframes are counted from the point you confirm them, so a delay in sending them is a delay in your delivery. Note that the 24-hour cancellation window runs from when you place your order, not from when you submit measurements.
• Limited returns. Tailored and bespoke garments cannot be returned for change of mind. They remain fully covered if they arrive damaged, defective, or do not match the measurements and specifications you confirmed. See our Returns & Refunds Policy.
• Fit is not an exact science. Even a well-executed garment may need minor adjustment. Where a small alteration would resolve the issue, we offer an alteration reimbursement of up to $50 as set out in our Returns Policy.

6. Pricing and Errors

All prices are shown in US dollars.

Despite our best efforts, a product may occasionally be listed at an incorrect price or with an incorrect description. Where we discover an error in an order you have placed, we will contact you before processing it, and you may either confirm the order at the corrected price or cancel it for a full refund. We are not obliged to fulfil an order placed at an obviously incorrect price.

We may change prices at any time. Changes do not affect orders already accepted.

7. Orders and Acceptance

Your order is an offer to buy. Our acknowledgement email confirms we have received it, but a contract is only formed when we accept the order and begin processing it.

We reserve the right to refuse or cancel any order, including where a product is unavailable, an error is identified, payment cannot be verified, or the order appears fraudulent or breaches these Terms. See our Cancellation Policy.

8. Payment

Payment is taken in full at checkout. We accept the methods displayed at checkout, processed securely by our payment providers. We do not receive or store your full card details.

By submitting payment information you confirm that you are authorised to use the payment method provided.

9. Taxes

The price shown is the price you pay. No sales tax or additional fees are added at checkout for orders delivered within the United States. The total displayed at checkout is the final amount.

10. Shipping, Returns and Cancellations

Delivery timeframes, shipping costs and delivery terms are set out in our Shipping Policy. Return eligibility, refund terms and remedies are set out in our Returns & Refunds Policy. Cancellation terms are set out in our Cancellation Policy.

Risk of loss passes to you on delivery by the carrier.

11. Promotions and Discount Codes

Promotions, discount codes and sale pricing are offered at our discretion, may be withdrawn at any time, cannot be combined unless expressly stated, and have no cash value. We may cancel orders where a code has been used fraudulently or in a way it was not intended.

12. Intellectual Property

All content on the Site — including photography, product imagery, text, graphics, logos, the Suit Heritage name and mark, page layout and design — is owned by or licensed to Suit Heritage and protected by US and international intellectual property law.

You may view and print content for your own personal, non-commercial use. You may not copy, reproduce, republish, distribute, or use our content or branding for commercial purposes, or to train machine learning or artificial intelligence systems, without our prior written permission.

13. Content You Submit

If you submit a review, photograph, comment or other material to us or to the Site, you grant Suit Heritage a non-exclusive, royalty-free, worldwide licence to use, reproduce and display it in connection with our business, including in marketing.

You confirm that anything you submit is your own, is accurate, and does not infringe anyone else's rights or contain unlawful, defamatory or offensive material. We may edit or remove submitted content at our discretion. We are under no obligation to keep submissions confidential.

14. Acceptable Use

You agree not to use the Site to: break any law; infringe any intellectual property right; transmit malware or harmful code; harvest or scrape data; interfere with the security or operation of the Site; submit false or misleading information; impersonate another person; or place fraudulent or speculative orders.

We may terminate your access for any breach of this section.

15. Third-Party Links and Services

The Site may contain links to third-party sites, and uses third-party services including payment processors, carriers and Google reCAPTCHA. We are not responsible for the content, policies or practices of third parties. Your use of their services is governed by their own terms.

16. Disclaimer of Warranties

The Site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any defect will be corrected.

Nothing in these Terms excludes or limits any warranty or right that cannot lawfully be excluded or limited, including under applicable state consumer protection law.

17. Limitation of Liability

To the fullest extent permitted by law, Suit Heritage and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, lost data, or loss of goodwill, arising from your use of the Site or any product purchased from it.

Our total aggregate liability arising out of or relating to any order will not exceed the amount you paid for that order.

Some states do not allow the exclusion or limitation of certain damages. Where that is the case, the above limitations apply only to the extent permitted.

18. Indemnification

You agree to indemnify and hold harmless Suit Heritage and its officers, employees and agents from any claim, demand, loss or expense, including reasonable legal fees, arising out of your breach of these Terms or your violation of any law or third-party right.

19. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law rules.

Any dispute arising out of or relating to these Terms or any purchase will be brought exclusively in the state or federal courts located in County, Texas, and you consent to the jurisdiction of those courts.

Nothing here prevents either party from seeking relief in small claims court, and nothing in these Terms limits any right you may have under the consumer protection laws of the state in which you reside.

20. Changes to These Terms

We may update these Terms at any time. The current version will always be posted here with its effective date. Changes apply from the date they are posted and do not affect orders already accepted. Continuing to use the Site after a change means you accept the updated Terms.

21. General

• Severability. If any provision is found unenforceable, the rest remains in force.
• No waiver. Our failure to enforce any provision is not a waiver of it.
• Assignment. You may not assign your rights under these Terms. We may assign ours in connection with a merger, acquisition or sale of assets.
• Entire agreement. These Terms, together with the policies referenced in them, form the entire agreement between you and Suit Heritage.
